Ms. Earman, you hit the nail on the head. Wonder why that wasn't appealed? Could it be because Mr. Thorpe was departing and didn't want to dig in any more?

The real question, which doesn't seem even asked during the trial as outlined above, is the Fairfax Co. administrative refusal to grant a building permit without a commitment to Fairfax Water, which seems to be more an anti-trust case. Why wasn't that question brought forward?

I have a question. How is possible that with the recent Fairfax County Circuit Court Action that a judge from Prince William or Loudoun was not called upon to preside over the motion? A judge that is a Fairfax County resident, who gets paid by Fairfax County, and works in a facility paid for by Fairfax County, whose clerks are employees of Fairfax County should not be able to rule on a question that would benefit a jurisdiction that pays him and appoints him.

Well writen. Do you know if the City had opinions from outside counsel in 2007 that recommended filing suit against the Fairfax County Water Authority?
